AI Acceptable Use Policy

1. Introduction
This AI Acceptable Use Policy ("AUP") governs your use of artificial-intelligence features ("AI Features") within the Ace platform ("Services"), provided by Ace & Momo LLC ("Provider," "we," "us"). This AUP is incorporated by reference into and forms part of the Terms of Use between you and Provider (the "Agreement"). Capitalized terms not defined here have the meanings given in the Agreement.
By accessing or using the Services or AI Features, you agree to comply with this AUP. If you do not agree, you may not use the AI Features. We may update this AUP at any time by posting a revised version; your continued use after the effective date of any change constitutes acceptance.
2. Core Responsibilities
You are solely responsible for:
- Your inputs. All AI Customer Input you submit — including text, images, data, and prompts — must comply with this AUP, the Agreement, and applicable law.
- Your outputs. AI Customer Output is generated automatically and may be inaccurate, incomplete, biased, or offensive. You must review and verify AI Customer Output before using, publishing, distributing, or relying on it for any purpose. Provider is not liable for any decision you make in reliance on AI Customer Output.
- Your compliance. You must ensure that your use of the Services and any content published through them complies with all applicable laws, regulations, platform terms, and industry standards, including those governing advertising, endorsements, consumer protection, and data privacy.
- Your Authorized Users. You are responsible for ensuring that all users you authorize comply with this AUP.
3. Prohibited Uses
You shall not use the AI Features to generate, store, transmit, publish, or facilitate any content or activity that:
(a) Violates Law or Harms Individuals
- Violates any applicable local, state, national, or international law or regulation.
- Constitutes, facilitates, or promotes illegal activity of any kind, including fraud, money laundering, human trafficking, or the sale of illegal goods or services.
- Constitutes, promotes, or facilitates child sexual abuse material (CSAM) or any sexual content involving minors.
- Incites, promotes, glorifies, or facilitates violence, terrorism, mass casualty events, or hate crimes.
- Harasses, threatens, bullies, defames, or stalks any individual.
- Discriminates against individuals or groups based on race, color, religion, national origin, sex, gender identity, sexual orientation, disability, age, or any other protected characteristic.
(b) Involves Deception or Manipulation
- Creates, distributes, or promotes disinformation, misinformation, or demonstrably false content designed to deceive consumers or the public, including fabricated reviews, testimonials, or endorsements.
- Creates realistic deepfakes or synthetic media of real persons without their consent, or uses synthetic voices or likenesses to impersonate individuals.
- Constitutes spam, unsolicited commercial communications, or phishing.
- Attempts to deceive users into believing they are communicating with a human when interacting with an AI system, or that AI-generated content was created by a human.
- Engages in manipulative dark patterns or exploits user psychology to produce coercive, deceptive, or harmful outcomes.
(c) Infringes Third-Party Rights
- Infringes any third-party copyright, trademark, trade secret, patent, right of publicity, or other intellectual-property or proprietary right.
- Violates the privacy or data-protection rights of any individual, including unauthorized collection, disclosure, or use of Personal Information.
- Violates applicable laws regarding employee or consumer monitoring without disclosure and consent.
(d) Involves Sensitive or High-Risk Decisions
- Makes or supports automated decisions with legally significant or similarly significant effects on individuals (such as hiring, firing, credit, housing, or health decisions) without appropriate human oversight, disclosure, and any required legal compliance (including with applicable AI transparency and automated-decision-making laws).
- Uses AI Customer Output as the sole basis for any decision that has a material impact on a person's life, safety, health, or legal rights.
(e) Creates Dangerous or Weaponized Content
- Generates instructions for, or facilitates the development of, chemical, biological, radiological, nuclear, or other weapons capable of mass casualties.
- Targets or attacks critical infrastructure (power grids, financial systems, emergency services, etc.) or safety systems.
- Facilitates or promotes cyberattacks, malware distribution, unauthorized access to systems, or other malicious cyber activity.
(f) Involves Unauthorized Political or Influence Activity
- Generates political campaign materials or other content designed to unduly influence elections, voting, or political processes in violation of applicable law, without appropriate disclosures.
- Creates or operates influence operations or coordinated inauthentic behavior on social platforms.
4. Content Restrictions and Standards
All AI Customer Input and AI Customer Output that you use, distribute, or publish through or in connection with the Services must:
- Be accurate and not misleading regarding your products, services, prices, or business practices;
- Comply with all applicable advertising standards and consumer-protection laws;
- Not contain sexually explicit, graphic violence, or other adult-only content unless your platform supports it and you have implemented appropriate age-gating or consent mechanisms;
- Not demean, degrade, or objectify individuals; and
- Not promote or glorify self-harm, suicide, or eating disorders.
5. Connected Third-Party Platforms
When you use the Services to generate content for or publish content to a Connected Account (such as Meta, Google Business Profile, or other social or review platforms), you must additionally comply with:
- The terms of service, community standards, advertising policies, and acceptable-use policies of each Connected Account platform;
- All applicable FTC Endorsement Guides and similar regulations governing sponsored content, testimonials, and endorsements — including making clear and conspicuous disclosures when required; and
- Any platform-specific restrictions on AI-generated content, including any labeling or disclosure requirements.
Provider is not responsible for ensuring that content generated by the AI Features complies with third-party platform policies; that responsibility rests solely with you.
6. Sensitive and Restricted Data
You shall not submit to the AI Features any data that constitutes Highly Sensitive Personal Information as defined in the Agreement, including:
- Government-issued identification numbers (e.g., Social Security numbers, passport numbers, driver's license numbers);
- Financial-account credentials or full payment-card numbers; or
- Biometric, genetic, health, or medical information about any identifiable individual.
You may not use the AI Features to Process personal information about minors under 13 (or the applicable age of digital consent in your jurisdiction) or to generate content targeting minors in connection with data collection.
7. Disclosures and Consents
Where required by applicable law or platform policy, you are responsible for:
- Disclosing to consumers or other individuals that content was generated or assisted by artificial intelligence;
- Obtaining any required consents before collecting, using, or Processing the personal data of individuals in connection with the AI Features; and
- Providing any required opt-out or objection mechanisms to individuals whose data is processed through the AI Features.
8. Monitoring and Enforcement
Provider reserves the right, but not the obligation, to monitor use of the AI Features to detect potential violations of this AUP. Provider may, in its sole discretion:
- Refuse to generate, or remove or disable access to, content that violates this AUP;
- Suspend or terminate your access to the AI Features or Services for any violation of this AUP; and
- Report any activity that violates applicable law to appropriate law-enforcement authorities.
PROVIDER DOES NOT UNDERTAKE TO MONITOR ALL CONTENT GENERATED THROUGH THE AI FEATURES AND EXPRESSLY DISCLAIMS ANY DUTY TO DO SO. PROVIDER WILL NOT BE LIABLE FOR ANY CONTENT GENERATED BY OR THROUGH THE AI FEATURES OR FOR ANY FAILURE TO DETECT OR REMOVE VIOLATING CONTENT. IF YOU BELIEVE ANY CONTENT GENERATED THROUGH THE SERVICES VIOLATES THIS AUP OR APPLICABLE LAW, PLEASE CONTACT US AT LEGAL@ACEANDMOMO.COM.
9. Modifications
Provider may update this AUP at any time by posting a revised version on its website. Unless Provider provides a different notice period, modifications become effective upon posting. Your continued use of the Services after the effective date of any modification constitutes your acceptance of the updated AUP. If you do not agree to the modified AUP, you must stop using the Services.
